Charlotte County Divorce Records
The Family Division of the Charlotte County Circuit Court handles local divorce cases. Divorce proceedings are instituted by one or both spouses to signal an intent to dissolve a marriage, and typically conclude with a formal judgment of dissolution issued by the presiding judge.
A divorce file features the initial petition and response, filed motions, financial statements, custody agreements, court orders, and the final judgment of dissolution. Depending on the specific case, it may also include transcripts, exhibits, and settlement agreements. Some of these documents are sealed under state law for privacy reasons. Otherwise, divorce records are public records, and the public may inspect information such as the names of the parties, the case number, the dates of initial filing and conclusion, and the divorce decree.
Members of the public may access divorce case documents, including a divorce decree or judgment, at the local clerk of courts’ office. Alternatively, one can order a divorce certificate from the state’s Bureau of Vital Statistics for divorces granted after June 6, 1927. The certificate becomes available 60 days after the divorce becomes official.
